Putin signed a law on optimizing public procurement
Russian President Vladimir Putin signed a law on uniform rules for applying the national regime in public procurement and procurement by individual legal entities, regulating import substitution issues. Law No. 318-FZ was published on the Internet portal of legal information.
The document was developed by the Ministry of Finance to further simplify procurement procedures for domestic products in accordance with the laws on the contract system in the sphere of public procurement (Federal Law No. 44) and on the procurement of goods (works, services) by state corporations, state companies and natural monopolies (Federal Law No. 223).
The law provides for the empowerment of the Russian government to withdraw goods from the national regime in certain cases. This will give the government the right to provide companies with preferences when purchasing domestic goods or goods from the EAEU countries if they compete with foreign ones at auctions.
It is also envisaged to introduce a single "second wheel" rule - a ban on participation in procurement of suppliers of foreign products if there is at least one offer of Russian goods. The current "third wheel" rule for the purchase of medicines (RF Government Resolution No. 1289 of 11/30/2015) should be canceled in January 2025.
The provision on providing a 15% price preference will be extended to all Russian-made goods. Currently, this rule applies only to the relevant list of products (Order of the Ministry of Finance of the Russian Federation No. 73N of 05/11/2022, Appendix 1).
The government will establish the specifics of determining the initial (maximum) contract price for domestic goods, works, services, in the procurement of which a ban/restriction (in relation to foreign products) or an advantage (for Russian products) provided for by procurement legislation will apply. The rule will also apply to contracts with a single supplier. The provisions of the law will come into force on October 1, 2024, and a number of provisions - on January 1, 2025. Now the government needs to prepare the appropriate regulatory framework.
The State Duma adopted the law in the third, final reading, in early August the Federation Council approved the document. The Association of Pharmaceutical Manufacturers of the Eurasian Economic Union (APPEEU) believed that the bill creates significant risks in procurement.

Russia has approved new rules for handling medical waste
President Vladimir Putin approved changes to the handling of medical waste. Amendments were made to Federal Law No. 89 "On Production and Consumption Waste", Federal Law No. 52 "On the Sanitary and Epidemiological Welfare of the Population" and Federal Law No. 323 "On the Fundamentals of Protecting the Health of Citizens". The innovations will come into force on July 1, 2025.
According to the innovations, the conditions and methods of waste management must be safe for public health and the environment, carried out in accordance with laws, sanitary standards and other rules. For this purpose, the classification of medical waste is used depending on the degree of its epidemiological, toxicological and radiation hazard.
- Class A medical waste (epidemiologically safe) will be transferred by medical institutions to regional operators for the handling of municipal solid waste.
- Class B (epidemiologically hazardous), B (extremely epidemiologically hazardous) and G (toxicologically hazardous) medical waste is subject to disinfection. Disinfection is carried out either by the persons whose activities generated the waste, or by those authorized to carry out this procedure. For this purpose, a special register must be created by decision of the regional authorities, where data on companies authorized to work with such waste will be entered.
- Class D medical waste (radioactive) is processed by a national operator in accordance with the rules for handling radioactive waste (this is a structure of Rosatom).
The Russian government will compile a list of facilities in the country where medical waste can be disinfected and rendered harmless.
In 2023, the State Duma calculated that the implementation of a new medical waste disposal system would require 7.7 billion rubles. At the same time, experts noted that this is essentially an analogue of the waste reform in the healthcare sector. As a result, the industry may receive an opaque monopolized scheme, when only companies controlled by regional administrations will be allowed to work with medical waste. The disposal process under the new system will cost clinics more and will be more difficult, experts interviewed by MV predicted. According to their estimates, the cost of removing medical waste may increase tens of times, and the reason for the price increase will be not only an increase in the integrity and qualifications of the contracting company.
