Roszdravnadzor recognizes debts as hopeless in the event of the payer's bankruptcy

Roszdravnadzor has approved the procedure for making decisions on recognizing debts on payments to the federal budget as hopeless for collection. For example, payments not paid within the established period will be recognized as hopeless for collection in the event of the bankruptcy procedure being completed, the debtor being declared bankrupt, or the organization being liquidated.

In addition, the measure will apply to cases of application of acts of amnesty or pardon in relation to those sentenced to a fine, the issuance of a resolution on the termination of enforcement proceedings or the exclusion of a legal entity from the Unified State Register of Legal Entities, as well as in the event of the death of the payer or his/her declaration of death.

The documents confirming the existence of grounds for making a decision to recognize the debt as hopeless will be a death certificate, a court order on the completion of bankruptcy proceedings or the sale of the bankrupt's property, an extract from the Unified State Register of Legal Entities on the termination of activities due to the liquidation of the organization or the exclusion of a legal entity, and others.

According to the thematic order, the functions of preparing the decision will be assigned to a permanent commission on the receipt and disposal of assets created by Roszdravnadzor. The composition of the commission of at least three people will be approved by an act of the head of the budget revenue administrator. Meetings of the commission will be held as debts subject to write-off are identified, but not less than once a year.

The commission will review the necessary documents within 10 working days, then after the meeting, also within 10 working days, it will issue a decision in the form of an act on recognizing the debt as hopeless. The act will contain the full name of the organization or the full name of the individual, TIN, OGRN, KPP, information about the payment for which the debt arose, the classification code of budget revenues of the Russian Federation, the amount of debt on payments, penalties and fines, the date of the decision to recognize the debt as uncollectible and the signatures of the commission members.

Refusal to recognize the debt as uncollectible will not prevent the issue from being reconsidered.

In August 2024, the Government of the Russian Federation approved an order according to which the pre-trial appeal procedure will become mandatory from September 1, 2024 when challenging the actions of state and municipal bodies related to the provision of a number of licenses and permits. The order will affect disputes when Roszdravnadzor issues a certificate for the right to import (export) narcotic drugs, psychotropic substances and their precursors, permits for the use of medical devices intended for the diagnosis of diseases, and others.

Olimp Health Group to open clinic in Moscow for 2 billion rubles

A multidisciplinary medical center "Olimp Clinic" (part of the Olimp Health Group) will open in the Begovoy district of Moscow by the end of 2024. It will include a 19-bed hospital, an operating room, and a consultative and diagnostic unit. More than 2 billion rubles have been invested in the construction and equipment of the clinic with an area of 6 thousand square meters.

As specified by the Moscow City Hall, the clinic will be located in a historic building built in 1954 at the address: 1st Yamskogo Polya Street. The building, built in the style of Stalinist classicism, has lost its historical appearance over time, so one of the conditions for opening the clinic was the reconstruction of the facility.

The second floor of the Olimp Clinic medical center will house general practitioners' offices, surgery and cardiology departments, ultrasound examinations, dressing and plaster rooms. The third floor will be occupied by endoscopy and rehabilitation units, neurologists', urologists' and otolaryngologists' offices. The fourth floor will house a ward block for 19 beds, the fifth - three operating rooms and an intensive care unit with three beds.

As of August 2024, the construction readiness of the facility was at the level of 90%. The volume of investments in the facility, as specified by the CEO of Olimp Clinic Kirill Chubur, amounted to more than 2 billion rubles.

The new clinic will be managed by Olimp Clinic Mars LLC. Among the founders of the company, in addition to the top managers of the Group Natalia Solovieva and Kirill Chubur, is the former head of the European Clinic of Sports Traumatology and Orthopedics ECSTO (part of EMC), traumatologist Andrey Korolev.

The Olimp Health Group includes six locations in Moscow and the Voronezh Region. The network includes the Olimp Health, Eucalyptus and Olimp Clinic family medicine clinics in the Voronezh Region, the Olimp Clinic and Ogni Olimpa medical centers in Moscow, as well as the Don sanatorium in Voronezh, which opened in April 2024.

The Group's revenue for 2023, according to the Vademecum Analytical Center, amounted to 3 billion rubles. In 2022, the same figure was 1.98 billion rubles, allowing the network to take 30th place in the rating of "TOP200 private multidisciplinary clinics in Russia".

The case of the supply of counterfeit PPE for 116 million rubles in Perm sent to court

The Investigative Committee of the Russian Federation for the Perm Territory has completed the investigation of the criminal case against Renat Yambaev, co-owner of RealService LLC from Ulyanovsk. He is accused of especially large-scale fraud (Part 4 of Article 159 of the Criminal Code of the Russian Federation) and the circulation of substandard medical products committed by an organized group (paragraph "a" of Part 2 of Article 238.1 of the Criminal Code of the Russian Federation). Investigators believe that Yambaev and other defendants supplied more than 1.1 million counterfeit disposable medical gowns to Perm for 116.1 million rubles. The criminal case with the approved indictment has been sent to the Leninsky District Court of Perm for consideration on the merits. According to investigators, from November 2021 to January 2022 (during the COVID-19 pandemic), Yambaev and his two alleged accomplices, whose names have not been disclosed, supplied counterfeit, unregistered, and low-quality medical gowns to clinics in Perm and the region. The goods were paid for from the Perm Territory budget.

The Investigative Committee began an investigation into the case of fraud with personal protective equipment (PPE) on August 11, 2023. Another case was added to this one, initiated on October 30 on the grounds of selling counterfeit products. Yambaev was detained in Ulyanovsk on November 1. The next day, by decision of the Sverdlovsk District Court of Perm, he was remanded in custody, and on November 8, a hearing was held in the Perm Regional Court to consider an appeal against the validity of his detention in a pre-trial detention center.

The defendant's lawyer asked the court to change the preventive measure to house arrest, cash bail, or a ban on certain actions. According to him, Yambaev does not plan to hide and is also cooperating with the investigation, but the prosecutor reminded of the gravity of the charges, noting that not all alleged accomplices and witnesses to the possible crime have been identified, and not all evidence has been found and seized. The judge agreed with the arguments of the state prosecutor and left Yambaev in pretrial detention until December 11. Renat Yambaev is a co-owner of three companies registered in Ulyanovsk. We are talking about Ecotek LLC (100% share), which is engaged in the processing of rubber waste, RealTorg LLC (20%, wholesale trade in solid and liquid fuels) and RealService LLC (25%, wholesale trade in textiles). According to SPARK-Interfax, RealService LLC was registered in Ulyanovsk in 2020. In addition to Yambaev, the company is owned in equal shares (25% each) by Sofya Klyuchnikova (formerly Polyakova), Olga Ralle and Evgeny Skitovich. The legal entity's revenue in 2023 amounted to 138.7 million rubles, net profit - 7.2 million rubles. The company's proposed contracts for the supply of PPE to clinics in the Perm Territory in the period from November 2021 to January 2022 are not reflected in SPARK-Interfax.

The government has allocated funding for the additional equipment of the hospital for war veterans in Omsk

About 385 million rubles will come from the government's reserve fund in connection with the request of the regional governor. With their help, at least 513 units of medical products, including equipment, will be purchased.

The additional equipment of the hospital will improve the quality and availability of medical care for war veterans living in the Omsk region.
